1. Scope, Acceptance, and Binding Effect
These Terms of Service apply to every visitor, applicant, registered user, student, mentor, administrator, operator, support contact, invite recipient, or other person who accesses or uses the platform in any way.
By visiting, registering for, logging into, integrating with, or otherwise using the platform, you agree to be bound by these Terms of Service, the Privacy Policy, challenge rules, assignment rules, funded-account rules, feature notices, and any additional policies or operational standards published by the platform. If you do not agree, you must not use the platform.
To the maximum extent permitted by law, the English version governs interpretation even if translations are provided for convenience. The operator may enforce these Terms separately from any other policy, and any failure to enforce a provision in one instance does not waive the right to enforce it later.
2. Eligibility, Authority, and Account Capacity
You represent and warrant that you have the legal capacity and authority to accept these Terms and use the platform. If you use the platform on behalf of an institution, business, team, or other organization, you represent that you are authorized to bind that entity.
If local law requires parental, guardian, employer, institutional, or other third-party permission, responsibility for obtaining such permission rests solely with you and not with the platform. The platform may restrict, suspend, or terminate access if it reasonably believes you are not eligible or not properly authorized to use the service.
3. Educational and Operational Nature of the Platform
The platform is designed for training, simulation, challenge administration, mentorship, analytics, review, and related operational workflows. Except where a feature expressly and lawfully states otherwise, balances, rankings, challenge results, analytics, and account states should be treated as platform outputs and not as statements of brokerage custody, regulated execution, or guaranteed financial reality.
Nothing on the platform constitutes financial advice, investment advice, legal advice, tax advice, fiduciary guidance, or an offer to buy or sell securities or other financial instruments. You are solely responsible for how you interpret or rely on any educational, simulated, ranked, or analytics output generated by the service.
4. Registration, Accuracy of Information, and Verification
You must provide accurate, current, and complete information during registration, onboarding, and subsequent use. You must not impersonate another person, hide your true identity in a deceptive manner, use email addresses or credentials you are not authorized to use, or create accounts through false or misleading means.
The platform may require email verification, anti-bot checks, proof-of-work, reCAPTCHA, Telegram verification, identity confirmation, or other technical or operational verification steps. The platform may reject, delay, limit, or revoke registration or login attempts if any verification mechanism fails, expires, is unavailable, or is reasonably suspected of being bypassed or abused.
5. Credential Security, Session Responsibility, and Device Risk
You are solely responsible for maintaining the confidentiality of your login credentials, verification links, device access, browser state, and any other mechanism that can authenticate or recover your account. You must promptly update credentials or contact support if you suspect unauthorized access.
You accept full responsibility for activity performed from your authenticated account until access is properly revoked. The platform is not responsible for losses or misuse caused by weak passwords, shared devices, browser extensions, malware, phishing, credential stuffing, leaked credentials, session theft, device compromise, or user failure to log out.
6. Limited License and Permitted Use
Subject to these Terms, the operator grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable permission to access and use the platform solely for its intended lawful purposes.
No ownership interest, implied license, partnership right, or distribution right is transferred to you. All rights not expressly granted are reserved by the operator and its licensors.
7. Prohibited Conduct
You must not use the platform in a way that is unlawful, deceptive, abusive, technically harmful, competitively exploitative, or inconsistent with the educational and operational purpose of the service.
- Impersonating any person or entity, misrepresenting your identity, affiliation, authority, or eligibility.
- Creating multiple accounts for unfair advantage, evading bans or restrictions, or circumventing challenge, waitlist, ranking, or funded-account rules.
- Using bots, scripts, scraping tools, automation, reverse engineering, credential attacks, prompt injection, load abuse, or any technical method intended to bypass safeguards or gain unauthorized insight or access.
- Manipulating rankings, challenge outcomes, assignment scoring, mentorship workflows, reviews, funded-account state, analytics, or eligibility logic through collusion, abuse, or dishonest behavior.
- Uploading, transmitting, or storing content that is unlawful, infringing, malicious, harmful, defamatory, invasive of privacy, or designed to impair the service or other users.
- Using the platform in violation of sanctions, export restrictions, employment duties, institutional rules, exchange/provider terms, or any applicable law or regulation.
8. User Content, Journals, Comments, and Communications
You retain responsibility for any text, images, notes, journal entries, comments, support submissions, profile content, or other material you submit or make available through the platform. You represent and warrant that you have the lawful right to provide such content and that doing so does not violate the rights of others or any applicable law.
By submitting content, you grant the operator and its service providers a broad, non-exclusive, worldwide, royalty-free right to host, copy, process, display, transmit, reformat, moderate, analyze, store, and otherwise use that content as reasonably necessary to operate, secure, improve, document, and defend the platform.
9. Challenges, Assignments, Groups, Rankings, and Certificates
Challenge, assignment, group, ranking, badge, and certificate features are governed by platform rules, local admin controls, feature availability, and operational decisions made by the service. Eligibility, participation, scoring, waitlists, disqualifications, and visible outcomes may change based on technical, policy, anti-abuse, or administrative factors.
The platform may suspend, re-run, reset, invalidate, edit, delay, or remove challenge and assignment data when reasonably necessary to respond to fraud, cheating, system defects, operational error, moderation review, legal risk, or infrastructure issues. The platform is not liable for any disappointment, reputational impact, opportunity cost, or other consequence arising from such changes.
10. Prop, Funded, and Exchange-Connected Features
If prop-program, funded-account, exchange-linked, or provider-linked features are made available, they may be subject to additional rules, verification steps, provider constraints, credential requirements, reconciliation logic, and risk controls. Availability of such features does not guarantee admission, activation, eligibility, profitability, payout, continuity, or continued access.
You are solely responsible for the legality, accuracy, authority, permissions, and suitability of any credential, account reference, or provider-side information you submit. The platform may reject, rotate, verify, freeze, suspend, close, or otherwise act on funded-related features without liability where reasonably necessary for security, policy enforcement, provider compliance, reconciliation, or risk management.
11. Fees, Taxes, Payments, and Refund Position
Unless a feature expressly states otherwise in a binding purchase flow or separate written agreement, the platform is not obligated to offer any paid service, refund, credit, reimbursement, or monetary remedy. If paid features are introduced, all fees may be charged as stated at the time of the transaction and may be non-refundable except where non-waivable law requires otherwise.
You are solely responsible for taxes, duties, banking fees, exchange fees, payment-provider fees, chargebacks, and all other financial obligations arising from your use of the service or any related third-party arrangement. The platform is not responsible for currency fluctuations, payment delays, failed processor events, banking restrictions, or third-party billing problems.
12. Availability, Maintenance, Changes, and Feature Retirement
The platform may add, remove, replace, suspend, redesign, localize, rate-limit, gate, or retire any feature, page, API, score, metric, notification path, or operational workflow at any time and for any reason, including testing, rollout control, abuse prevention, infrastructure changes, legal concerns, business priorities, or provider dependency issues.
No feature, page, or output is guaranteed to remain available, stable, backward compatible, or uninterrupted. Temporary or permanent discontinuation of a feature does not create a duty to continue service, restore access, preserve data indefinitely, or compensate users for disruption or loss.
13. Third-Party Services, Data Sources, and External Dependencies
The platform may depend on third-party infrastructure, analytics, anti-bot controls, messaging systems, email delivery, market-data providers, storage providers, media services, exchanges, funded-account providers, and other external systems. Those systems may change, fail, delay, deny access, corrupt data, alter policies, or become unavailable without warning.
The operator does not guarantee the accuracy, continuity, legality, or suitability of third-party data or services and is not liable for harm caused by provider downtime, filtering, API behavior, policy changes, deprecations, access denials, or upstream errors.
14. Monitoring, Enforcement, Suspension, and Termination
The operator may monitor use of the platform, review logs, preserve evidence, investigate suspicious behavior, and take enforcement action at any time where reasonably necessary to protect the service, users, providers, or legal position of the operator.
Enforcement actions may include warnings, content removal, score invalidation, challenge disqualification, access restriction, login blocking, account freezing, funded-feature suspension, credential rotation, referral to third parties, or permanent termination. The operator has no obligation to provide advance notice, appeal rights, or reversal unless required by non-waivable law.
15. Intellectual Property and Platform Materials
The platform, including its software, code, interfaces, content structure, branding, graphics, layouts, data compilations, challenge systems, analytics presentations, and related materials, is protected by intellectual-property and other applicable laws.
Except for the limited use rights expressly granted in these Terms, you may not copy, adapt, republish, distribute, resell, sublicense, scrape, decompile, reverse engineer, create derivative works from, or otherwise exploit the platform or its materials without prior written authorization from the operator or applicable rights holder.
16. Disclaimers, No Warranty, and No Guarantee of Outcome
The platform and all related services, content, data, rankings, analytics, notifications, simulations, challenge outputs, funded states, and integrations are provided on an as-is and as-available basis. To the maximum extent permitted by law, the operator disclaims all warranties and representations, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted availability.
The platform does not guarantee that outputs will be correct, current, profitable, fair, complete, lawful for your purpose, accepted by a third party, or free from defects, delays, bias, ambiguity, omission, stale data, translation mismatch, or operational inconsistency.
17. Assumption of Risk and No Reliance
You use the platform entirely at your own risk. You accept the risk of account compromise, technical malfunction, bad data, stale analytics, delayed notifications, challenge-rule changes, score recalculation, provider failure, moderation error, funded-feature disruption, legal uncertainty, and any other consequence of relying on a live software service.
You are solely responsible for evaluating whether platform content, analytics, mentor feedback, rankings, challenge results, funded states, or communications are appropriate for your own purposes. You must not rely on the platform as a substitute for professional financial, legal, tax, compliance, security, or operational advice.
18. Limitation of Liability and Exclusion of Damages
To the maximum extent permitted by law, the operator and all related persons and entities are not liable for any direct, indirect, incidental, consequential, exemplary, punitive, reputational, regulatory, educational, employment, commercial, market, or financial damages arising from or related to the platform, including lost profits, lost opportunity, lost ranking, failed challenge outcomes, score changes, funded-account actions, data loss, service interruption, third-party outages, delay, unauthorized access, or reliance on platform outputs.
Where liability cannot be fully excluded, it will be limited to the smallest amount permitted by applicable law. Nothing in these Terms requires the operator to reimburse, restore, reconstruct, or compensate for losses caused by user error, provider error, third-party conduct, or ordinary platform risk.
19. Indemnification
You agree to defend, indemnify, and hold harmless the operator, its affiliates, personnel, contractors, licensors, service providers, successors, and assigns from and against claims, demands, investigations, liabilities, losses, damages, judgments, settlements, fines, penalties, costs, and expenses, including reasonable legal fees, arising from or related to your use of the platform, your content, your breach of these Terms, your violation of law, your violation of third-party rights, or any misuse of credentials or integrated accounts connected to you.
20. Governing Rules, Dispute Handling, and Injunctive Relief
To the maximum extent permitted by law, disputes must first be raised through the operator’s official contact or support channels with sufficient detail to permit review. The operator may investigate, request clarification, preserve evidence, and attempt informal resolution, but is not obligated to accept any proposed resolution or timeline.
Subject to mandatory law and any separately published or contracted forum-selection terms, the operator may seek injunctive, equitable, or protective relief in any competent forum where it reasonably considers such relief necessary to protect the platform, evidence, infrastructure, intellectual property, or user safety.
21. Changes to These Terms
The operator may modify these Terms at any time to reflect feature changes, legal developments, operational needs, anti-abuse controls, provider constraints, or business priorities. Unless a later date is stated, changes may take effect immediately when posted.
You are responsible for reviewing the current Terms before using or relying on the platform. Continued use after an update means you accept the revised Terms. If you do not agree, your sole remedy is to stop using the platform.
22. Contact
Questions, notices, or disputes relating to these Terms should be sent through official platform support channels or any official contact details published by the operator. Communications may be retained as support, compliance, security, and legal records.
No response time, remedial action, or dispute outcome is guaranteed unless required by non-waivable law or an express separate written agreement signed by the operator.
